By submitting a photo on Discover.buffalo.com in conjunction with this contest, and in consideration for receiving the opportunity to have the photo considered for publication in The Buffalo News and/or for posting on Buffalo.com, contestant acknowledges, understands, and agrees to the following terms:
 
ELIGIBILITY- NO PURCHASE NECESSARY. There is no fee to enter and the contest is open to any New York State resident 18 years of age or older, except employees of The Buffalo News, The Talking Phone Book, associated sponsors and agencies, their assignees, licensees, and members of their immediate families living in the same household. Contest can only be entered online. Entrants may only submit original photos that they themself have taken, for which they own all legal rights to have the photo which has been entered published. Entrant warrants that he or she has obtained express written permission to use the images of anyone appearing in the photograph and will provide a copy of such consent upon the request and demand of contest sponsors. Photos must be high-quality; taken directly from entrant’s camera and not pulled from any website; must be less than 2 MB in size; in jpeg or gif format; and, must not be obscene, defamatory, in bad taste or violate the privacy rights of any person or entity. Entrant may submit multiple photos.  This offfer is void where prohibited by law.
 
HOW TO ENTER: Access Discover.buffalo.com, or www.buffalo.com and click on the Contest tab. Entries may be submitted beginning May 16th, 2010 and may be submitted up to and including August 20, 2010 at 11:59 p.m.  Early entries will be eligible for weekly prizes.
 
ENTRY RULES AND DISCLAIMERS: The Buffalo News, The Talking Phone Book, associated sponsors, their agencies, their assignees, and licensees are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen, misdirected or illegible entries. Entry materials/data that have been tampered with or altered are void. Once submitted, entries become the sole property of The Buffalo News and The Talking Phone Book and will not be returned. In case of dispute as to identity of a winner, such entry will be declared made by the registered user of the e-mail account, and if a prize is won, and such registered user is a valid entrant, the prize will be awarded to such registered user. Contest organizers are not responsible if Entrant is unable to enter online for any reason.
 
HOW PRIZES ARE AWARDED: Weekly prizes will be chosen based on photo quality and originality. Weekly prize winners and honorable mention winners will be named contest finalists. Grand Prize, First Prize, Second Prize, and Third Prize will be chosen by random drawing among all contest finalists. Winners of weekly prizes are eligible for the final prize drawing.
 
Weekly prizes will be chosen every Thursday, beginning May 27th and ending August 26th 2010. Grand Prize and 1st, 2nd, & 3rd prize winners will be chosen on August 26th 2010, and will be announced at the National Buffalo Chicken Wing Festival, September 4 – 5th 2010.
Representatives of The Buffalo News will judge all entries and the judges' decisions are final. All photos will become the property of The Buffalo News, and the entrant releases all rights to the photo, including use of entrant’s name in connection therewith, to use, exhibit, print, publish or re-publish, in any medium whether print, electronic or otherwise,  for news, advertising, or otherwise, and for immediate release without prior inspection by the entrant.
Entrants need not be present to win. Notification to winners will be directed to the phone or email that was included on the contest registration forms. Winners will have to claim their prizes at The Buffalo News. 
 
Some restrictions may apply. Chances of winning will be determined by the total number of entries received.

PRIZE ACCEPTANCE: Prizes must be accepted as awarded, no cash equivalents, no substitutions. Contest sponsors reserve the right to award a prize of equal or greater value in the event of unavailability of the listed prize. CONTEST SPONSORS SPECIFICALLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE WITH RESPECT TO ANY PRIZES AWARDED IN CONJUNCTION WITH THIS CONTEST. Winners agree to allow use of their name, address and photo for publicity without compensation. Contest sponsors are not responsible for any injury incurred by a contestant as a result of winning or participating . Any taxes are the sole responsibility of the winner.
The decisions of the contest organizers are final on all matters of fact, interpretation, eligibility, procedure and fulfillment.
This contest is subject to all federal, state and local regulations and is void where restricted or prohibited by law. All taxes, title, registrations, releases and insurance owed in connection with any prize will be the sole responsibility of the prize winners. A prize value of $600 or more requires a W-9 form be completed before the prize package can be released.   Winner may be required to sign an affidavit of eligibility and liability prior to release of the prize. Failure to do so will result in the selection of an alternate winner. Sponsor reserves the right, in its sole discretion to cancel, terminate, or suspend this contest should viruses, bugs, unauthorized human intervention or other causes beyond the control of Sponsor(s) corrupt or impair the administration, security, fairness, or proper play of the contest. In such event, the winner will be selected by random drawing from all eligible entries received up to the time of such cancellation, termination or suspension.
